If you have separate agreements, your landlord can take steps to market you (e.g.B for rent arrears). It`s a good idea to use a colocation contract. A common law agreement is more flexible than a housing rental agreement because roommates can agree to all the terms. However, because each term must be negotiated and agreed, common law agreements are often not as comprehensive or defined as a housing rental agreement. This may mean that it takes more time and money to resolve the disputes that arise. If you have a roommate in your own home, you are not automatically covered by residential tenancy law. Many people living in dwellings or flatshares live in multi-occupancy houses (HMO). If you live in an HMO, your landlord has additional legal responsibilities and may need a license for the property. You can have a license if someone else in your household has a lease with the landlord, but not you. These are rights and obligations for tenants and landlords created by government and territorial governments. The housing rental right applies automatically if your contract applies to an entire building (i.e. an entire house or apartment). Landlords and tenants can agree that the right to rent accommodation applies when the contract provides for a part of a piece of land (i.e.
a rental of space) with access to community facilities. If you live in a common house, but you rent to a tenant who resides in the property, you are probably an excluded user. You can download a sample colocation agreement from the Tenancy Services website: If you share a home, if only your name appears on the electricity bill, you are legally responsible for the entire bill until you terminate the contract. If your name is on the bill and someone else who lives with you doesn`t pay their share, you normally have to pay the bill and take legal action against them for the money. If you have a problem with another tenant, it is best to try to solve all the problems between them. However, if this is not possible, you can contact your landlord. Since you all have individual leases, your landlord might decide to take action against the tenant in question. If they did, it wouldn`t affect your lease. If you share your home with other people, it`s important to know how your rental is organized, as it can impact other things. This page highlights some of the issues you need to consider when sharing homes.
Common Law can only apply to a room rental agreement with shared access to the facilities. It cannot apply to an agreement to lease an entire piece of land (i.e. an entire house or apartment). If you rent part of a house or unit to another tenant – and that tenant has a written lease with the owner of the premises – then they are your primary tenant. Additional rules apply if your home is a multi-occupancy home, for example if your home has a certain number of unrelated people….
